TERMS OF SERVICE

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE SHOPPING WITH US. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SECTION 17) THAT AFFECT YOUR LEGAL RIGHTS. BY BROWSING THIS STORE, CREATING AN ACCOUNT, JOINING A LIVE SHOW, PLACING A CLAIM OR BID, OR MAKING A PURCHASE, YOU AGREE TO THESE TERMS IN THEIR ENTIRETY.

These Terms of Service ("Terms") are a legally binding agreement between you ("Customer," "you," or "your") and Big J's Stuff LLC ("Seller," "we," "us," or "our"), the independent business that owns and operates the online store at bigjstuff.com, including its live shows, auctions, product listings, customer accounts, checkout, and related features (collectively, the "Site").

By accessing or using the Site in any manner, including browsing, creating an account, watching a live show, placing a claim or bid, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. The Refund Policy, Shipping Policy, and any additional policies posted on this page are also part of these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SITE OR MAKE A PURCHASE.

Refund Policy

All items are sold as is. We guarantee all products 5 days From the day of receiving purchase. If the product is damaged or defective, big j will give a full refund for the item. No buyers remorse returns.

1. WHO WE ARE AND WHAT THESE TERMS COVER

This store is independently owned and operated by Big J's Stuff LLC. When you buy from this Site, your purchase contract is directly and solely between you and Big J's Stuff LLC. Except for Vendor Products (see Section 9), we are the merchant of record for every sale made through the Site.

The Site runs on storefront software licensed from a third-party technology provider. That provider is a software vendor only: it is not a party to any purchase you make, it does not hold or process your payments, and it has no responsibility for the products sold through the Site.

These Terms govern your use of the Site and every purchase you make through it, whether from a fixed-price listing, a live show claim, or an auction.

2. ELIGIBILITY AND ACCOUNTS

2.1 Age Requirement

You must be at least eighteen (18) years of age to create an account, participate in live shows, place claims or bids, or make purchases on the Site.

2.2 Your Account

Some features, such as claiming items during live shows or saving a payment method, require an account. You agree to:

  • Provide accurate, current, and complete information when creating your account and keep it updated;
  • Keep your login credentials confidential and not share your account with others;
  • Notify us promptly if you believe your account has been accessed without your authorization.

You are responsible for activity that occurs under your account. Claims, bids, and purchases made through your logged-in account are treated as made by you.

3. HOW BUYING WORKS

3.1 Fixed-Price Listings

When you place an order for a fixed-price item, you are making an offer to purchase that item at the listed price plus any applicable tax and shipping. Your order is accepted when we confirm it or charge your payment method. We may cancel an order before fulfillment due to pricing or listing errors, item unavailability, or suspected fraud; if we cancel, any amount you were charged for the canceled item will be refunded.

3.2 Live Show Claims

During live shows, you may claim an item by using the claim feature or by the claim method announced during the show. PLACING A CLAIM IS A BINDING COMMITMENT TO PURCHASE that item at the price announced or displayed, plus any applicable tax and shipping.

  • Claims are awarded in the order received as recorded by the Site's systems. Because of streaming and network delay, the order shown in chat or on screen may differ from the system's records; the system's records control.
  • Quantity claims (for example, claiming more than one of an item) are binding for the full quantity claimed.
  • We are not responsible for claims that are not received due to your connection, device, or network issues.

3.3 Auctions

The Site may offer live countdown auctions and timed auctions. Each bid you place is a binding offer to purchase the item at that bid amount plus any applicable tax and shipping. Bids may not be retracted. If you are the highest eligible bidder when an auction closes, you win the item and are obligated to complete the purchase. We may void bids or cancel an auction in cases of listing error, technical malfunction, or suspected bid manipulation.

3.4 Cancellations by the Seller

We may cancel a claim, winning bid, or order if the item is found to be unavailable, damaged, or materially misdescribed, if a pricing or technical error occurred, or if we suspect fraud or a violation of these Terms. If we cancel, our sole obligation is to refund any amount you were charged for the canceled item.

4. PRICING, PAYMENT, AND CARD ON FILE

4.1 Prices and Taxes

All prices are stated in U.S. dollars unless otherwise noted. Applicable sales tax is calculated and added at checkout or invoicing based on the shipping or pickup location, as required by law. Shipping charges, where applicable, are added per the Shipping Policy posted on this page.

4.2 Payment Processing

Payments are processed by a third-party payment processor (currently Square). We do not see or store your full card number; your payment details are handled by the processor under its own terms and privacy policy. By submitting payment information, you represent that you are authorized to use the payment method provided.

4.3 Card on File

If you save a payment method to your account, you authorize us to charge that payment method for items you claim during live shows, auctions you win, and related tax and shipping, in accordance with these Terms and the policies posted on this page. You may remove a saved payment method at any time; removal does not cancel obligations for claims or bids already placed.

4.4 Declined Payments

If your payment method is declined, you remain responsible for completing payment for your claims, winning bids, and orders by another valid payment method within the payment window stated on your invoice or in our posted policies.

5. INVOICES AND UNPAID ITEMS

Items you claim or win may be collected onto an invoice, including a combined invoice issued during or after a live show. Payment is due by the deadline shown on your invoice or stated in our posted policies or during the show.

If an invoice is not paid on time, we may:

  • Cancel the unpaid claims or winning bids and return the items to inventory or offer them to other customers;
  • Charge a saved payment method on file as authorized under Section 4.3;
  • Restrict your ability to claim or bid in future live shows;
  • Suspend or close your account for repeated non-payment.

6. SHIPPING, LOCAL PICKUP, AND RISK OF LOSS

Shipping methods, costs, handling times, and any local pickup options are described in the Shipping Policy posted on this page and at checkout. Delivery dates are estimates, not guarantees; carrier delays are outside our control, though we will reasonably assist with carrier claims.

Risk of loss passes to you when the package is delivered to your shipping address or when you (or someone you authorize) pick up the item. If your order arrives damaged, or a delivered package is missing items, notify us within the timeframe stated in the Shipping or Refund Policy so we can address it and pursue any carrier claim.

7. RETURNS AND REFUNDS

Returns, exchanges, and refunds are governed by the Refund Policy posted on this page. Where a listing or a live show announcement states that an item is final sale, that designation applies to the extent permitted by law.

Approved refunds are issued to your original payment method or as store credit, as described in the Refund Policy. Nothing in these Terms limits any right you may have under applicable consumer protection laws that cannot be waived by agreement.

8. PRODUCT DESCRIPTIONS AND CONDITION

We describe items in good faith, and the live video presentation of an item during a show is part of its description. Please note:

  • Many items sold through the Site are secondhand, vintage, collectible, or one-of-a-kind and may show wear consistent with age and use;
  • Unless an item is described as professionally graded or certified, statements about condition or grade are our good-faith opinion;
  • Colors and details may appear differently depending on your screen and the live stream quality;
  • If you have questions about an item, ask before you claim or bid.

9. VENDOR PRODUCTS SOLD THROUGH THIS STORE

Some items offered on the Site or during live shows are supplied by independent third-party vendors ("Vendors") who sell their products through this store. When you purchase a Vendor product:

  • The Vendor — not Big J's Stuff LLC — is the seller of that product and is solely responsible for the product, including its quality, safety, authenticity, condition, legality, and the accuracy of any claims the Vendor makes about it;
  • We host the sale and process the checkout, but WE DO NOT GUARANTEE OR WARRANT VENDOR PRODUCTS IN ANY WAY, to the maximum extent permitted by law;
  • ANY DISPUTE ABOUT A VENDOR PRODUCT — including defects, damage, authenticity, or a product that does not match its description — MUST BE DIRECTED TO THE VENDOR. We may choose to help put you in contact with the Vendor, but we are not obligated to resolve product disputes on a Vendor's behalf;
  • Returns and refunds for Vendor products follow the Refund Policy posted on this page unless different terms are stated for that item at the time of sale;
  • Vendor items may be shipped or handed off by the Vendor directly, and their handling times may differ from ours;
  • To protect your privacy, a Vendor receives only the limited information needed to fulfill your order — typically your name, shipping address, and contact details — and is prohibited from using that information for anything other than fulfilling your order (see Section 18.4).

In all other respects — claims, bids, payment, invoices, and conduct rules — these Terms apply to Vendor items the same as to any other item.

10. LIVE SHOWS AND CUSTOMER CONDUCT

We want live shows to be fun and fair for everyone. When participating in live shows, chat, or any other interactive feature, you agree that you will NOT:

  • Harass, threaten, demean, or abuse the host, staff, or other customers;
  • Post spam, advertising, self-promotion, or links to other stores or services;
  • Place claims or bids you do not intend to honor, or interfere with other customers' claims or bids;
  • Manipulate auctions, including bidding in coordination with others to inflate or suppress prices;
  • Impersonate any person, use another customer's account, or operate multiple accounts to evade restrictions;
  • Record, rebroadcast, or redistribute live shows or Site content for commercial purposes without our written permission;
  • Use the Site for any unlawful purpose.

We may moderate chat, remove messages, mute or remove participants, cancel claims or bids, and suspend or ban accounts for conduct that violates this section, without notice or liability.

11. TEXT MESSAGES, EMAIL, AND NOTIFICATIONS

We send transactional communications, such as order confirmations, invoices, receipts, and shipping updates, as part of doing business with you. You agree to keep a valid email address on your account.

If you opt in to marketing or alert messages, such as "text me when we go live" SMS alerts or our email newsletter, the following applies:

  • Consent to marketing messages is not a condition of making any purchase;
  • Message frequency varies, and message and data rates may apply;
  • You can reply STOP to any text message to unsubscribe, or HELP for help;
  • You can unsubscribe from marketing emails using the link in any message.

12. GIFT CARDS, STORE CREDIT, AND REWARDS

Gift cards sold through the Site are redeemable only at this store, have no cash value, and may not be redeemed for cash except where required by law.

Store credit, loyalty rewards, VIP benefits, and referral credits are promotional in nature: they have no cash value, are non-transferable, may not be redeemed for cash, and may be modified, adjusted, or discontinued as described in the applicable program terms, to the extent permitted by law. Credits or rewards obtained through fraud or abuse may be revoked.

13. CHARGEBACKS AND BILLING DISPUTES

If you believe a charge is incorrect, please contact us first using the information in Section 22 — most billing issues can be resolved quickly. Filing a chargeback on a valid charge without first attempting to resolve the issue with us may result in suspension of your account. We reserve the right to contest chargebacks with our records, including claim and bid logs, invoices, communications, and delivery confirmation.

14. INTELLECTUAL PROPERTY

The Site's content — including live show video, product photos, descriptions, branding, and logos — belongs to us or our licensors and is protected by applicable intellectual property laws. We grant you a limited, personal, non-transferable license to access the Site to browse, participate in live shows, and shop. You may not scrape, copy, redistribute, or commercially exploit Site content without our prior written permission.

15. THIRD-PARTY SERVICES

The Site relies on third-party services, including payment processing, streaming, and shipping carriers. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for their acts, omissions, or outages, except as required by law.

16. DISCLAIMERS, LIMITATION OF LIABILITY, AND INDEMNIFICATION

16.1 The Site

THE SITE ITSELF (INCLUDING LIVE STREAMS, CHAT, AND CHECKOUT) IS PROVIDED "AS IS" AND "AS AVAILABLE." We do not guarantee that the Site will be uninterrupted or error-free, that live streams will be free of delays or disruptions, or that every claim or bid attempt will be received.

16.2 Products

EXCEPT AS EXPRESSLY STATED IN AN ITEM'S DESCRIPTION OR IN THE REFUND POLICY POSTED ON THIS PAGE, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTS ARE SOLD WITHOUT IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Any manufacturer's warranty that accompanies a new product is between you and the manufacturer. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

16.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PURCHASE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US FOR THE PURCHASE OR PURCHASES GIVING RISE TO THE CLAIM. TO THE SAME EXTENT, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

16.4 Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right in connection with your use of the Site.

17. DISPUTE RESOLUTION: BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

17.1 Talk to Us First

Before starting any formal dispute, you agree to contact us using the information in Section 22 and give us thirty (30) days to work toward resolving the issue informally. Most concerns can be resolved this way.

17.2 Agreement to Arbitrate

If we cannot resolve a dispute informally, you and Big J's Stuff LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any purchase shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, before a single arbitrator. The arbitration hearing, if any, will be held in the county where you reside or conducted remotely by video, at your election. Either party may instead bring an individual claim in small claims court if it qualifies.

17.3 Class Action Waiver

YOU AND BIG J'S STUFF LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY.

17.4 Opt-Out Right

You may opt out of this arbitration provision by sending us written notice (including your name and the email address on your account) within thirty (30) days of first accepting these Terms, using the contact information in Section 22. Opting out of arbitration does not affect any other part of these Terms.

17.5 Severability of This Section

If the class action waiver in Section 17.3 is found unenforceable, then this entire arbitration provision shall be null and void, and the dispute shall proceed in court. If any other portion of this Section is found unenforceable, the remaining portions remain in effect.

18. BECOMING A VENDOR: VENDOR PROGRAM TERMS

This Section 18 applies only if you apply for and are approved to sell your products through this store as a Vendor. It is a business-to-business agreement between you ("Vendor") and Big J's Stuff LLC, in addition to the rest of these Terms, which also apply to you.

18.1 Independent Businesses

You are an independent business. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship between you and us. You have no authority to act for us or bind us, and you are solely responsible for your own income taxes, insurance, business licenses, and permits.

18.2 Your Products Are Your Responsibility

Although your products are presented and checked out through this store, YOU remain the seller of your products and are solely responsible for them, including:

  • The legality, safety, quality, condition, and authenticity of every product you offer;
  • The accuracy of your product descriptions and any claims made about your products;
  • Not offering counterfeit, stolen, recalled, or prohibited items, or items that infringe any third party's intellectual property rights;
  • Honoring the Refund Policy posted on this page (or the item terms stated at the time of sale) for your products;
  • Fulfilling your orders on time under the fulfillment method agreed with us.

18.3 Commissions, Payouts, Refunds, and Chargebacks

Sales of your products are processed through our checkout. We deduct the commissions and fees agreed for your vendor account before payout. Refunds, chargebacks, and payment disputes involving your products may be deducted from or offset against your payouts, and we may withhold a reasonable amount pending resolution of open disputes.

18.4 Customer Information

Customers who buy through this store are OUR customers. In connection with your orders, you receive only the limited customer information needed to fulfill them — typically the customer's name, shipping address, and contact details. You agree that you will:

  • Use that information solely to fulfill the specific order and for no other purpose;
  • Not use it for marketing, solicitation, or building your own customer list;
  • Not sell, share, or disclose it to anyone else;
  • Keep it confidential and delete it once it is no longer needed for fulfillment or required for your records by law.

Misuse of customer information is grounds for immediate termination of your vendor account and any other remedies available to us.

18.5 No Guarantees by Us

We do not guarantee any sales volume, air time, listing placement, or promotion of your products. We may decline, remove, or stop presenting any of your products at any time at our discretion. The Site is provided to Vendors "as is," and Section 16 applies to your use of it.

18.6 Vendor Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your products (including product liability, personal injury, property damage, and intellectual property claims), your violation of these Terms, or your violation of any law or third-party right.

18.7 Termination at Will

Either you or we may end the vendor relationship AT ANY TIME, WITH OR WITHOUT CAUSE AND WITH OR WITHOUT NOTICE. Upon termination: your listings are removed; orders already paid for will be fulfilled or refunded; and your final payout is made after deducting commissions, fees, refunds, chargebacks, and any amounts reasonably withheld for open disputes. Sections 18.2, 18.4, and 18.6 survive termination.

18.8 Vendor Disputes with Us

Any dispute between a Vendor and us is subject to Section 17 (arbitration and class action waiver), except that the AAA's Commercial Arbitration Rules apply instead of its Consumer Arbitration Rules.

19. TERMINATION

You may close your account at any time by contacting us. We may suspend or terminate your account for violation of these Terms, fraud or suspected fraud, abuse of the Site or its participants, repeated non-payment, or chargeback abuse.

Termination does not affect obligations that arose before termination: you remain responsible for unpaid invoices, and we remain responsible for delivering or refunding items you have already paid for.

20. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date, and we will make reasonable efforts to notify account holders of material changes. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. The version of these Terms in effect at the time of a purchase governs that purchase.

21. GENERAL PROVISIONS

21.1 Governing Law

These Terms are governed by the laws of the state in which Big J's Stuff LLC is organized and maintains its principal place of business, without regard to conflict of law principles, except that the Federal Arbitration Act governs Section 17.

21.2 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and the Refund, Shipping, and additional policies posted on this page, are the entire agreement between you and us regarding the Site and your purchases.

21.3 Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it.

21.4 Assignment

You may not assign these Terms. We may assign these Terms in connection with a sale or transfer of our business; your rights under these Terms are not diminished by any such assignment.

21.5 Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier disruptions, utility or internet outages, government actions, or other force majeure events. If such an event prevents us from fulfilling a paid order, we will refund it.
